In Texas civil litigation, service of process is the essential first step toward holding someone legally accountable in court. When someone is sued and fails to respond after proper service, the court may issue a default judgment — a powerful tool that allows the plaintiff to win without a trial.
Whether you’re a creditor, a defendant, or just want to understand how lawsuits move forward in Texas, this guide explains the core concepts of service and default judgments.

🧾 What Is Service of Process?
Service of process is the legal method used to formally notify a defendant that a lawsuit has been filed against them. This notification is a constitutional requirement — without it, the court lacks authority to issue any judgment.
Methods of Service in Texas:
- Personal service – A process server or constable physically hands the lawsuit papers (citation and petition) to the defendant.
- Substitute service – If personal service fails, the court may authorize:
- Leaving the documents with someone over 16 at the residence
- Serving via certified mail
- Electronic or social media service, in rare cases, with court approval
- Service by publication – Used only when the defendant cannot be found despite diligent efforts.
✅ For service to be valid, it must comply strictly with Texas Rules of Civil Procedure 106 and 107. Improper service may render any judgment void or subject to reversal.
⏳ What Happens After Service?
Once the defendant is served, the clock starts ticking. In most Texas civil cases:
- The defendant has until 10:00 AM on the Monday following 20 days from the date of service to file an answer with the court.
- Failing to respond by that deadline exposes the defendant to a default judgment.
In many cases, the original creditor (like a bank or credit card company) has sold the debt to a third-party debt buyer, such as Midland Credit Management, Portfolio Recovery Associates, or LVNV Funding.
Other times they are original creditors like Chase, Bank of America, American Express or Capital One.
⚖️ What Is a Default Judgment?
A default judgment occurs when the defendant does not file an answer or appear in court after proper service. In such cases:
- The plaintiff can ask the court to enter judgment without a trial, based solely on the pleadings and any required proof of damages.
- If the claim is for a set amount (like a debt or contract), the judge may sign the judgment immediately.
- If damages are unliquidated (like personal injury or fraud), a prove-up hearing may be required to establish the amount owed.
📝 The judgment becomes enforceable just like one after a full trial — including the right to collect through garnishment, turnover orders, or even receiverships.
📌 Can a Default Judgment Be Set Aside?
Yes, but timing is critical. A defendant may file:
- A Motion for New Trial within 30 days of the judgment
- A Restricted Appeal within 6 months if no answer or appearance was filed
- A Bill of Review up to 4 years later, but only under limited circumstances (e.g., fraud, wrongful service, or lack of actual notice)
Judges have discretion, especially if the defendant can show that:
- The failure to answer was not intentional or the result of conscious indifference
- There’s a meritorious defense to the plaintiff’s claim
- Granting a new trial won’t unduly delay or prejudice the plaintiff
✅ Final Thoughts
✅ Service of process is the first — and arguably most important — step in any Texas civil lawsuit.
✅ If a defendant fails to respond after proper service, the plaintiff can obtain a default judgment, often without a trial.
✅ Defendants who act quickly may be able to set aside a default, but delays can permanently close the door.
